Ministerial Directions

Section 31 of the Planning and Development Act gives the Minister the power to direct a planning authority to take specific measures in relation to a plan (development plan, variation to a development plan or a local area plan).

This is usually done in cases where the Minister is of the opinion that a planning authority has ignored or has not taken sufficient account of the Minister’s statutory observations, if the plan fails to set out an overall strategy for proper planning and sustainable development, if the plan is not in compliance with the Planning Acts or where the plan of a planning authority in the Greater Dublin Area is not consistent with the transport strategy of the National Transport Authority.
